These Terms apply to all services, quote requests, shipment arrangements, communications, and website use involving Island Trade Link LLC (“Company,” “we,” “us,” or “our”).

By requesting a quote, using our website, tendering cargo, or using our services, you agree to these Terms to the fullest extent permitted by law.

1. Service Scope

We provide shipping, logistics, freight coordination, quote support, and related services. Specific services may vary by shipment, destination, carrier availability, operational limitations, and applicable law.

2. No Guaranteed Delivery Dates

Any delivery date, transit time, sailing date, or arrival estimate is an estimate only unless expressly guaranteed in a signed written agreement. We are not liable for delays caused by carriers, ports, customs, inspections, congestion, weather, labor issues, governmental action, force majeure, or other circumstances beyond our reasonable control.

3. Customer Responsibilities

The customer is responsible for providing complete and accurate shipment information, including cargo descriptions, dimensions, weights, addresses, declared values, and any required documentation.

The customer is also responsible for proper packaging, labeling, and lawful tender of goods. We are not responsible for losses, delays, fines, or extra charges caused by inaccurate information, improper packaging, prohibited goods, or missing documentation.

4. Rates and Charges

Quotes and pricing are subject to change until confirmed. Final charges may vary based on destination, shipment size, service type, storage, special handling, carrier charges, customs issues, port charges, fuel surcharges, or other third-party or operational costs.

5. Payment

Payment is due as stated on the applicable quote, invoice, or service communication. We may withhold cargo release, delivery coordination, or service performance until payment is received in full.

6. Limitation of Liability

To the fullest extent permitted by law, Island Trade Link LLC is not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, lost opportunities, market loss, or delay-related damages.

To the fullest extent permitted by law, any liability for loss, damage, nondelivery, misdelivery, or delay shall be limited to the lesser of:

• the actual direct provable loss,
• the declared value accepted by us in writing before shipment, if any,
• any lower liability limit set by the applicable carrier, warehouse, bill of lading, tariff, or governing law,
• or, if no other measure applies, $100 per shipment.

7. Claims

Any claim for loss, shortage, damage, delay, or nondelivery must be made in writing within:

• 5 calendar days after delivery for visible loss or damage, or
• 5 calendar days after the expected delivery date for nondelivery or shortage,
• or any shorter deadline required by a carrier, warehouse, bill of lading, tariff, or applicable law.

Claims not made within the required period are waived to the fullest extent permitted by law. Supporting documents may be required, including shipment details, photos, invoices, and proof of loss.

8. Third-Party Services

Our services may involve third-party carriers, warehouses, terminals, delivery providers, customs-related providers, and other service partners. Their own terms, tariffs, warehouse receipts, bills of lading, and liability limitations may apply.

9. Ocean Freight Notice

To the extent our services involve ocean freight, those services may also be governed by federal maritime law, Federal Maritime Commission requirements, carrier tariffs, and related transportation documents. This page does not replace those separate governing documents.

10. Governing Law

Except to the extent controlled by federal maritime law or other mandatory law, these Terms shall be governed by the laws of the State of Florida.
